THE ABOVE LEGISLATION IS APPLICABLE IN COLOMBIA, BOLIVIA, PERU, ECUADOR AND VENEZUELA

 

DEFINITION

  • Integrated Circuit it is deemed to be a product in its final or intermediate form, whose elements, of which someone is an active element and some or all the interconnections make an integrating part of the body or of the surface of a material piece, intended to perform some electronic work.
  • The three dimension concept is deemed as a TRACING BOARD as expressed in any arrangement of devices, being at least one of them an active device, plus an integrated circuit interconnections, as well as the three dimension arrangement which is prepared for an integrated circuit intended to be manufactured.

SUBMISSION OF THE INTEGRATED CIRCUIT TRACED BOARD

  • If the tracing board has been commercially exploited any where in the world, the registry application shall be submitted before the authorized national entity of the member country within a term of two (2) years from the first date for the commercial explotation of the tracing board.
  • If the tracing board above has not been commercially exploited no where in the world, it can be registered if requested before the authorized national office of the member country within a term of 15 years from the last day of the year in which the tracing board was created.

DURATION OF THE TRACING BOARD

  • Ten (10) years from the oldest of the dates below:
    - The last day of the year in which the first exploitation of the tracing board has taken place, in any place in the world.
    - The date in which the registry application has been filed on before the authorized national office in the relevant member country

TRACING BOARD PROTECTION

  • Throughout the territory of Colombia.

TRACING BOARD EXPLOITATION

  • The holder of a tracing board registry shall exploit it within four (4) years from the date of the application, or three (3) years from the granting date.

TRACING BOARD MAINTENANCE

  • No maintenance rates of the tracing board are required to be paid.

RIGHTS GRANTED

  • The right to prevent third parties from reproducing, commercializing, importing or offering in sale the above tracing board.

THERE IS NO ANDEAN TRACING BOARD REGISTRY

  • For purposes of the protection of a tracing board, it is necessary to register it each of the Cartagena Agreement member countries.

TRACING BOARD TRANSFER

  • This transfer can be made with respect to one which has been already granted or being pending to be granted either by an acting among live persons or by succession.

TRACING BOARD LICENCE

  • A licence agreement can be entered with respect to a granted or pending tracing board, so as to enable third parties to exploit the invention. The licence shall be made in writing and properly registered.

NOTE

  • There is no Andean tracing board circuits. For the assuring purposes thereto, the registration thereof in each of the Cartagena Agreement member countries will be required.
